These General Terms and Conditions are intended to regulate the relationship between AstroCafe, with registered office and address: Wolfgang-Schmälzl-Gasse, 1020 Vienna (hereinafter referred to as the PROVIDER), and the customers, hereinafter referred to as USER and/or CONSUMERof the e-commerce website ASTROCAFE.AT, hereinafter referred to as“ASTROCAFE.AT”..

Use of the Website

Any use of the website https://astrocafe.at means that you have carefully read these General Terms and Conditions and agree to comply with them unconditionally. The Terms may be amended by ASTROCAFE.AT at any time through updates. The changes are binding for all clients and/or users. ASTROCAFE.AT has the right to unilaterally amend the Terms at any time at its discretion or if required by a legal act. In all cases, users will be informed of changes by publication on the website.

By using the website, the user declares that they are over 16 years of age or have parental consent.

It is prohibited to copy, transmit, distribute, store, or otherwise use any part or all of the content in any form without explicit written permission from ASTROCAFE.AT. It is prohibited to use the website to send or transmit any unlawful, threatening, false, misleading, abusive, defamatory, obscene, pornographic, or otherwise inappropriate content, or any material that encourages illegal activity or violates applicable law.

User Registration Obligations

By using the virtual bookstore https://astrocafe.at, the user agrees to provide true, accurate, and up-to-date information when completing the registration form. For security and protection of users, ASTROCAFE.AT informs parents that products and services are accessible to a wide audience and that determining appropriate use for children is their responsibility. The user may stop using the services at any time. Upon termination of the agreement, ASTROCAFE.AT will delete the user profile and access password. Termination requests must be sent via email to hello@astrocafe.at

 

Personal Data Protection Policy

1. ASTROCAFE.AT undertakes the necessary measures and bears the due responsibility for the protection of the personal data of the User, which become known to it in connection with and as a result of the use of the site Astrocafe.at by the User, except in cases of force majeure, accidental event or malicious acts of third parties.

2. In the fields of the registration form completed by the User when creating a profile on Astrocafe.at and in the fields of the online order form on Astrocafe.at, ASTROCAFE.AT clearly marks the mandatory and voluntary elements of the provided personal data, as well as the result of refusal to provide them. By agreeing to these General Terms and Conditions, the User expresses consent for their data to be processed in the manner provided herein. The User profile created upon initial registration is set up in such a way that it allows free access to the personal data declared by the User. Subsequently, if desired, the User has the right and technical possibility, through editing the settings, to restrict or prohibit access to their personal data.

3. In the event that the User or persons under their control have carried out malicious actions within the meaning of these General Terms and Conditions or have violated the rights or legitimate interests of third parties, ASTROCAFE.AT has the right to provide the User’s personal data to the competent state authorities in accordance with applicable Bulgarian legislation.

4. ASTROCAFE.AT collects and uses information about Users solely for the purposes provided for in these General Terms and Conditions. The personal data provided by Users is used by ASTROCAFE.AT for analysis and improvement of the efficiency and operation of Astrocafe.at; for managing online orders created; for delivery of ordered products; for secure processing of payments via encrypted connection; for communication with Users regarding online orders and products. ASTROCAFE.AT stores personal data for a period of 5 years. With each subsequent provision, a new five-year period begins.

5. By agreeing to these General Terms and Conditions, the User agrees to the processing of their personal data for the purposes of the distance sales contract concluded on the Astrocafe.at website.

6. By agreeing to these General Terms and Conditions, the User agrees that their personal data, declared as publicly available in their user profile on Astrocafe.at or anywhere else in cyberspace, may be used and distributed by ASTROCAFE.AT for the purposes of direct marketing, unless the User explicitly prohibits access to them. The User’s actions on Astrocafe.at (created orders, questions asked, etc.) and information about their online orders (number, price, specific titles, total amount) may always be used by ASTROCAFE.AT for direct marketing purposes, where this does not contradict applicable Bulgarian legislation.

7. ASTROCAFE.AT undertakes not to disclose any part of the User’s personal data and not to provide collected information to third parties – state authorities, commercial companies, individuals and others, except in cases where:

– it has received the explicit consent of the User at registration or at a later stage;

– the information is requested by state authorities or officials authorised under applicable law;

– personal data is provided to companies processing personal data for the purposes of games organised by a marketing agency;

– other cases provided for by law.

8. By registering on Astrocafe.at, the User agrees that personal, advertising or other commercial messages may be sent to their user profile on Astrocafe.at or anywhere else in cyberspace or to their declared email address by ASTROCAFE.AT.

9. When placing an online order, ASTROCAFE.AT processes personal data of the User necessary for the fulfilment of the online order created by the User – name, telephone number, address, email and personal identification number /when an invoice for a natural person is requested/.

The User agrees that, upon conclusion of a distance sales contract, part of their personal data will be provided to the respective subcontractor company for the purpose of delivering the online order. Such personal data are: name, address, telephone number.

 

Confidentiality of Communication

Users, by accepting these General Terms and Conditions, agree that the data provided by them through which contact with them may be established may be used by ASTROCAFE.AT for sending messages and conducting correspondence related to consequences arising from the use of the Astrocafe.at website.

 

Right of Objection

The User has the possibility at any time to express in writing an objection to the processing of their personal data by ASTROCAFE.AT. The User may submit a claim and withdraw their consent for their personal data to be processed by ASTROCAFE.AT by sending an email related to the specific situation to hello@astrocafe.at.

Refusal to receive advertising messages does not automatically mean withdrawal of consent to these General Terms and Conditions.

 

Use of IP Addresses, Cookies and Other Technical Data

For the purpose of improving the quality of the website, Astrocafe.at monitors which sections are visited and how long these visits last. This monitoring is carried out through the registration of IP addresses of users’ computers as well as through the use of cookies. The registration of the IP address is part of system administration and does not imply direct identification of the visitor. The site monitoring system also observes other system parameters such as operating system, browser type, screen resolution, etc., which do not constitute personal data and cannot be used for user identification and are used for statistical purposes. Search phrases entered by users in search forms are also monitored, but in aggregated form that does not allow them to be linked to specific users.

Cookies are small text files that the web server stores on users’ devices in order to track traffic generated by the user on the website. Cookies are used by the online ordering system of the site as well as other functions. Each time the user adds a product to their order, the information is stored on the device. Cookies are updated each time the user visits Astrocafe.at. They cannot be used for identification – they only recognise that Astrocafe.at has been visited in the past and thus help improve user experience. Each website can access only its own cookies. Cookies do not contain personal data, but may contain information entered by the user. Cookies do not provide access to data stored on the device memory. Third-party advertising partners also use cookies. Cookies are also used by Google Analytics and social network plugins installed on the site.

ASTROCAFE.AT and its service providers use the following types of cookies:

  • essential cookies – these types of cookies are necessary for the functioning of the Astrocafe.at website, for example user sessions. Disabling this type of cookies means the inability to log into the user’s account on Astrocafe.at, to place an online order, and to perform any other basic functional actions.

  • performance and functionality cookies – these types of cookies are related to users’ preferences and user recognition; providing information related to users’ preferences; analysis of the performance of the Astrocafe.at website; temporary storage of anonymised information through which relevant suggestions are provided to users; and in connection with auxiliary website activities.

You may also reject our cookies; however, in this case there is a risk that certain functions in some sections of the website may not be active, for example the ordering of publications. Until you change your browser settings, cookies will be stored/updated each time you access our website, and by using it you agree to this.

Third-party cookies for advertising purposes may also be used (Google Ads, Facebook Ads, etc.).

ASTROCAFE.AT uses external services—advertising networks—which may also place cookies in the user’s browser. These cookies are managed by the respective services and are not controlled by ASTROCAFE.AT. The data they contain is anonymized. These external services are intended to enable the execution of advertising campaigns. They may use cookies for the purpose of identifying users and personalizing advertisements for our platform on external websites and services. External advertising of this nature includes Google AdWords, Facebook Ads, and others.

 

Prices

All prices are final and do not include additional charges. 

The Provider has the right to change prices at its own discretion and at any time, without being obliged to provide prior notice to Users. The User is obliged to pay the price that was valid at the time the order was placed. In the event of technical errors in the publication of product prices on the website, the Provider has the right to refuse to fulfill the order and shall not owe any compensation to the User in any form.

The Provider reserves the right to withdraw all products from the online store on the website and may, at its sole discretion, refuse to process an order for any reason at any time, without prejudice to the User’s statutory rights. The Provider shall not be liable to the User or any third party for the withdrawal of any product/program from the online store or for the refusal to process any order.

In the case of price reductions, the discounted prices are displayed with the new price shown alongside the old price, which is crossed out.

 

Payment

Payment can be made using a credit/debit card. The User is required to confirm that the credit/debit card used belongs to them. All credit/debit card holders are subject to verification and authorization by the card issuer. The Provider reserves the right to refuse credit card payments at its reasonable discretion.

The Provider undertakes to provide the service to the User only after the payment for the respective product has been credited to its bank account.

If the amount cannot be collected due to insufficient funds, incorrect banking details, or if the customer refuses the debit despite not being entitled to do so, the customer shall bear any fees generated by each refund or failed transaction charged by the relevant credit institution, if these are a result of the customer’s actions. 

 

Delivery

Once the User has made payment for the selected product and the payment has been credited to the Provider’s bank account, the User will receive an email at the address provided containing a link to the ordered product. Registered users can also view the ordered program in their account profile.

 

Refund of Paid Amounts for Product

Due to the nature of the products offered, namely text (PDF) files downloaded to the User’s personal device after payment, any amounts paid for them are non-refundable.

Amounts paid for a text (PDF) file may be refunded only in the event of a proven technical error during payment, namely when the User has mistakenly paid for the same product more than once within a single order. In such cases, the Provider shall refund the amount exceeding the price of one product.

 

Rights and Obligations of the Parties

  • Users are not allowed to disable or disrupt the website’s functionalities or to carry out malicious attacks.
  • The type and specifics of the website’s functionalities may be changed unilaterally at the Provider’s discretion.
  • All users are granted the right to use the website’s services solely for personal/non-commercial purposes, in compliance with applicable legislation and the requirements set out in these General Terms and Conditions.
  • The content of the website is determined by the Provider, who also has the right to modify the website content at any time, at its discretion, by adding and/or removing sections and/or materials.
  • Access to the website may be temporarily suspended or restricted for maintenance purposes or the introduction of new services. Due to the nature of the Internet, uninterrupted access cannot be guaranteed.
  • Users are not allowed to disable or disrupt the website’s functionalities or carry out malicious attacks.
  • The Provider is entitled to compensation for all damages, costs, and third-party claims resulting from a breach of these General Terms and Conditions and/or unauthorized use of the website’s services.
  • Users are not allowed to extract, by technical means or otherwise, information resources or parts of information resources belonging to databases located in the online store.

Users undertake to:

  • provide an accurate and valid email address for correspondence;
  • pay the price of the ordered product;
  • take all reasonable care and necessary measures to protect their password;
  • not submit fictitious or invalid requests or other false information. The User bears full responsibility for safeguarding their password as well as for all actions performed by them or by a third party using it;
  • comply with legislation, these General Terms and Conditions, Internet etiquette, moral rules, and good customs.
  • The Owner has the right to deactivate or delete the username and password for access to a registered User’s profile in case the User infringes the Owner’s intellectual property rights over the website’s content and other intellectual property objects.

 

Links to Third-Party Websites

The website https://astrocafe.at may contain special links (links, hyperlinks) to other websites maintained by third parties. The Provider is not responsible for the legality, completeness, accuracy, or timeliness of the content of third-party information resources linked from this site, nor for the legality of the activities of such third parties.

The website owner does not operate, control, or assume responsibility for the information, products, and/or services found on external websites. Such links do not constitute or imply endorsement of the accuracy or reliability of any information, products, and/or services provided on or through external websites, including, without limitation, any warranties of any kind, express or implied, warranties of title or non-infringement, or implied warranties of merchantability or fitness for a particular purpose.

All content on the website, including articles, pages, audio/video/text materials, logos, graphic images, inscriptions, images, and other resources, belongs to the Owner and is protected under the Copyright and Related Rights Act of the Republic of Bulgaria, the Private International Law Code, and EU copyright regulations.Unauthorized use is considered a criminal offense, and offenders will be held liable under civil and criminal law according to Bulgarian and international legislation. Copying, sharing, reproducing, distributing, broadcasting, transmitting, modifying, or otherwise using such materials constitutes a copyright infringement and is subject to legal action and criminal liability under the Bulgarian Penal Code.

No materials from this website may be modified in any way, nor copied, publicly distributed, or disseminated for any public or commercial purpose.

 

Copyright in Digital Products

All digital products offered for sale on https://astrocafe.at are copyrighted works. The Provider holds exclusive copyright over them. By purchasing a digital product, the Provider grants the User a non-exclusive right to use the product solely for personal, non-commercial use. Unauthorized use is considered a criminal offense and will result in civil and criminal liability under Bulgarian and international law. Copying, sharing, reproducing, distributing, broadcasting, transmitting, modifying, or otherwise using such products constitutes copyright infringement and is subject to legal action and criminal liability under the Bulgarian Penal Code.

 

Limitation of Liability

  • The website owner is not responsible for subjective perceptions or interpretations regarding the accuracy, completeness, or usefulness of the website’s information resources.
  • The owner is not responsible for the information (including its completeness and accuracy) contained in websites linked from this site.
  • The owner is not liable for any damages suffered by users as a result of force majeure or circumstances beyond its control that cannot be avoided, such as temporary website outages due to technical reasons. 
  • The owner is not liable for damages resulting from any inability or lack of access to the website.
  •   The owner is not responsible for subjective perceptions or expectations regarding the quality and effect of audio and video files offered for sale.
  •   The owner is not obliged to provide any compensation or refund if the User is not satisfied with the product.

 

Dispute Resolution

All disputes arising from or relating to these General Terms and Conditions, including disputes concerning their interpretation, validity, performance, termination, gaps, or adaptation to new circumstances, shall be resolved through mutual agreement and compromise. 

 

Severability Clause

If any provision of these General Terms and Conditions is or becomes invalid, unlawful, or unenforceable, this shall not affect the validity of the remaining provisions.

 

Applicable Law

All matters not covered by these General Terms and Conditions shall be governed by the applicable legislation of the Republic of Bulgaria.

 

Changes to the General Terms and Conditions

Due to periodic updates and modifications of the Services, their improvement and expansion, as well as possible legislative changes affecting them, these General Terms and Conditions may be amended unilaterally by the Provider. Such changes may also occur due to changes in the type, nature, or technology of the Services provided, termination of certain Services, or changes in economic conditions.

In case of changes to the General Terms and Conditions, the Provider shall inform Users by publishing them on the website.
